1. The Promotor
1.1 Vax ‘Win the value of your product back’ Competition ("Promotion") is promoted by Vax Ltd, whose registered address is Artillery House, Heritage Way, Droitwich, West Midlands, UK, WR9 8YB ("Promoter").
1.2 Entry into Promotion is deemed acceptance of this Agreement. Entrants will be subject to the terms of use of the Vax website found here https://www.vax.co.uk/terms-and-conditions
2. ELEGIBILITY
2.1 This Promotion is open to any UK resident over the age of 18 years at the date of entry.
2.2 Employees, officers and directors of Vax Ltd and its affiliated companies or their family members or anyone else connected in any way with the Promotion or helping to set up the Promotion shall not be permitted to enter the Promotion.
2.3 Entrants are responsible for ensuring that they are entitled to participate and proof of eligibility may be required and prizes withheld until Promoter is fully satisfied the above criteria are met.
2.4 There is no entry fee to enter this Promotion; however, internet connection and mobile data rates may apply to the entrant. The cost of accessing the Promotion website will be dependent on the entrant’s individual internet service provider and shall be the responsibility of the entrant only. Promoter holds no liability towards entrant costs.
2.5 By entering this Promotion, an entrant is indicating his/her acceptance and agreement to be bound by these terms and conditions.
3. HOW TO ENTER
3.1 The Promotion begins 14th April 2022 at 00:01 and ends at 11:59pm on 30th April 2023 (GMT) (the “Promotion Period”).
3.2 Route to entry for the Promotion and details of how to enter are via www.vax.co.uk/registration. Entrants who purchase and register an eligible Vax appliance as listed in Annex 1 (“Eligible Appliance”) either directly via www.vax.co.uk or via a retail channel shall be eligible to enter this Promotion.
3.3 To enter the Promotion, entrants must follow the instructions set out below:
3.3.1 Direct purchases via Vax website
Eligible Appliances purchased via www.vax.co.uk are automatically registered for warranty via www.vax.co.uk/registration For the avoidance of doubt, these direct purchases via www.vax.co.uk shall automatically be entered into the Promotion.
3.3.2 Purchases via Retail Channel
(i) Eligible Appliances purchased via a retail channel must be registered by the entrant either using the following link: www.vax.co.uk/registration or by scanning the QR code (with a mobile phone device) found inside the box of the Eligible Appliance, which will take entrants to the link mentioned in this subsection.
(ii) Entrants must then complete a warranty registration form with the following details: first name, surname, address, postcode email, contact number (i.e. mobile number), product model number, product serial number, battery serial number (if applicable), purchase date, purchase price, retailer purchased from, proof of purchase and press submit button at the bottom of the page.
(iii) Entrants must then agree to the T&C’s and privacy policy of the Promotion presented on the screen.
(iv) Once the entrant completes the steps above and submits the warranty registration form, a confirmation message shall appear on the screen.
(v) All Eligible Purchases must be new and genuine Vax appliance. Purchases of second hand, refurbished or reconditioned products, and purchases from auction websites (e.g. eBay) as well as products imported from outside the EEA or products which are counterfeit or infringe the intellectual property rights of the Promoter in any way will not qualify for this Promotion.
3.4 For the avoidance of doubt, entrants can enter the Promotion based on the number of Eligible Appliances purchased from the Promoter or a retailer subject to clause 3 (i.e. every Eligible Appliance either purchased directly from Vax.co.uk or registered equals one entry) for the duration of the Promotion Period.
3.5 All entrants have the right to withdraw from the Promotion by emailing [email protected].
3.6 Any Eligible Appliances returned directly to the Promoter or via a retail channel shall be automatically withdrawn from the Promotion.
3.7 Bulk entries made from trade, consumer groups, syndicates or the like will not be accepted. We will not accept cheating in any form including the use of macros or other automated means of entry, masking of identity by manipulating IP addresses, using any false identity or any other behaviour that falls outside the spirit of the promotion (to be determined at our absolute discretion). Any entrant found to be cheating will be excluded.
3.8 Promoter accepts no responsibility for entries not received, deleted, altered or that are invalid, regardless of the reason.
4. PRIZES AND WINNERS ANNOUNCEMENT
4.1 The winners shall be able to claim back the value of their purchased Eligible Appliances (‘Prize’) (via the Promoter or the retail channel from where the Eligible Appliances was purchased) throughout the Promotion Period, as currently made available by the Promoter in the UK market. The Promoter reserves the right to modify the Prize set out under this clause 4.1, at any time for the duration of the Promotion Period.
4.2 There shall be five prize winners per month who will be chosen at random using a computer-generated selection software by the Promoter from all valid and correct entries on the final day of each month and the winners will be contacted within 3 working days.
4.3 The Prize will be refunded within 30 working days from the date the winners each provide and/or confirm their bank details and/or proof of purchase to the Promoter.
4.4 For the avoidance of doubt all winners must complete full registration of their Eligible Appliances via the link set out at clause 3.3.2(i) and/or provide proof of purchase in order to be able to claim their Prize. Should a winner fail to comply with this clause 4.4, the Promoter reserves the right to withdraw the Prize from the winner and select a replacement winner.
4.5 The winners will be notified by email and/or telephone call (subject to the details already provided) where the Promoter will request bank details to issue a refund for any purchased Eligible Appliances via a retail channel. All Eligible Appliances via the Promoter shall be refunded automatically via the bank details used to purchase the Eligible Appliance. If a winner cannot be contacted or does not claim the Prize within fourteen (14) days of notification, the Promoter reserves the right to withdraw the Prize from the winner and select a replacement winner. The Promoter shall have no liability for winner’s failure to receive notices due to spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information.
4.6 Promoter is not responsible for inaccurate details supplied to any entrant by any third party connected with this Promotion. The prizes are not transferable. Prizes are subject to availability and the Promoter reserves the right to substitute any prize with another of similar characteristics without giving notice.
4.7 The Promoter’s decision in respect of all matters to do with the Promotion will be final and no correspondence will be entered into.
5. DATA PROTECTION
Personal data relating to the entrants will be used for the purposes of this Promotion in accordance with the current GDPR legislation and the Promoter’s Privacy Policy found at https://www.vax.co.uk/privacy-policy.
5.1 The Promoter reserves the right to contact all entrants to verify their personal data. For the avoidance of doubt, any entry made in relation to the Promotion as set out at Clause 3 will be deemed to have given consent for the Promotor to process all personal data as defined under Art.4 (1) General Data Protection Regulation 2016/ 679.
6. GENERAL
6.1 Promoter reserves the right to cancel or amend the Promotion and these terms and conditions without notice at any time including any prizes. Any changes to the Promotion will be notified to entrants as soon as possible by Promoter.
6.2 The Promotion and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.
6.3 If any provision of these terms and conditions are held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
6.4 Insofar as is permitted by law, the Promoter, its agents or affiliates will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
